سامری خیرخواه و‌جواز سقط جنین

چکیده
مقا‌لة جودیث جارویث تامسون با عنوان «در دفاع از سقط جنین» یکی از تأثیرگذارترین مقالات در مسئلة‌ی مهم سقط جنین از منظر اخلاقی ا‌ست، به گونه‌‌ای که پس از‌ انتشار آن در سال 1971‌م. تا-کنون بیشترین بازچاپ و نقد و بررسی را به خود اختصاص داده است. وی در مقام استدلال بر مدعای خویش از تمثیل بهره می‌برد و با تکیه بر مثا‌ل‌هایی نظیر ویولن‌نواز، هنری فوندا، سارق، شکلاتهای دو برادر و سامری خیر‌خواه سعی در اثبات مدعا‌ی خویش دارد. در مقاله‌ی پیش رو یکی ازتمثیل‌های او، یعنی داستان سامری خیر‌خواه بررسی و نقد می‌شود و تمایز او میان سامری حد‌اقلی و حد‌اکثری و نیز تمایز میان حقوق و اخلاق به چالش کشیده خواهد شد.

Judith Jarvis Thomson's "Defense of Abortion" is one of the most influential papers about Permissibility of abortion, So that after its publication in 1971 it has reprinted and criticized frequently. She uses the analogy as a reason for her claim and by relying on examples such as violinist, Henry Fonda, thief, two brothers' chocolates and good Samaritan tried to prove her claim. In this article, one of her allegory namely the story of good Samaritan will be criticized and reviewed and her distinction between minimally good Samaritans and maximally good Samaritan as well as her distinction between law and morality will be challenged.
